Article 1. Purpose
The purpose of these terms and conditions of sale is to define the contractual relationship between CATALEYAPARIS and the buyer and the conditions applicable to any purchase made through the website www.cataleyaparis.fr. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares that the purchase of products on the www.cataleyaparis.com website is not directly related to his/her professional activity and is limited to strictly personal use, and that he/she has full legal capacity to commit to these general terms of sale.
CATALEYA PARIS reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in effect at the date of the order by the buyer.
Article 2. Products
The products offered are those listed on the website www.cataleyaparis.fr of CATALEYAPARIS , while stocks last. The company CATALEYAPARIS reserves the right to modify at any time the range of products. Each product is presented on the website in the form of a description of its main technical characteristics (capacity, use, composition ...). The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented in the site www.cataleyaparis.com is intended for all the purchasers residing in the countries which fully authorize the entry on their territory of these products.
The products are made to order and according to personalized sizes.
Article 3. Prices
The prices appearing on the product sheets of the internet catalog are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. CATALEYAPARIS reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order.
Article 4. Order and payment terms
Before any order, the buyer must create an account on the site www.cataleyaparis.com. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile ...), will have to identify himself using this information. CATALEYAPARIS offers the buyer the option of ordering and paying for its products in several stages, with two payment options to choose from:
- Payment by bank transfer: the buyer selects the products he/she wishes to order in the "shopping cart", modifies if necessary (quantities, references...), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Stripe payment card". Finally, the last step proposes to him to check all the information, to take knowledge and to accept the present general conditions of sale by notching the corresponding box, then invites him to validate his order by clicking on the button "Order". This last click constitutes the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. Upon receipt of the transfer, the order will be processed and the buyer will be informed by e-mail. CATALEYA will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to availability.
- Secure payment by Paypal or credit card (via the PAYPAL system): the buyer selects the products he/she wishes to order in the "shopping cart", modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: "Payment by Paypal". The next step proposes to verify all the information, to read and accept the present general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the button "Confirm my order". Finally, the buyer is redirected to the PAYPAL secure interface in order to safely enter his Paypal account or personal credit card references. If the payment is accepted, the order is recorded and the contract is definitively formed. The payment by Paypal account or by credit card is irrevocable. In case of fraudulent use of the card, the buyer can demand the cancellation of the payment by card, the sums paid will then be credited or returned. The responsibility of the bank card holder is not engaged if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or even 120 days if the contract binding him or her to the bank so provides. The amounts debited will be reimbursed by the bank within a maximum of one month after receipt of the Cardholder's written objection. The holder will not be charged for the return of the sums.
The confirmation of an order implies acceptance of these terms of sale, the recognition of having perfect knowledge of them and the renunciation to prevail oneself of one's own conditions of purchase. All the data provided and the recorded confirmation will be considered as proof of the transaction. If the purchaser has an e-mail address and has provided it on the order form, CATALEYAPARIS LLC E will send the purchaser confirmation of the order by e-mail.

Article 5. Reservation of ownership
CATALEYAPARIS retains full and complete ownership of the products sold until full payment of the price, in principal, fees and taxes included.
Article 6. Withdrawal
The right of withdrawal includes exceptions. For example, it is excluded for the "supply of goods made to the consumer's specifications or clearly personalized". (Article L. 221-28 of the Consumer Code), which is the case of CATALEYAPARIS , which makes its clothes to order.
The customer has 48 hours to report his article for manufacturing defect or bad model, after this period CATALEYAPARIS will not accept any returns.
Please contact us by email ([email protected]) to receive the complete shipping address in case of error from CATALEYA.
No returns will be accepted without first contacting us via the contact page or by email ([email protected]), and will be returned to the sender.
Upon receipt of your return, we will examine the product and reserve the right to refuse it if it does not meet the following conditions :
be new, unworn, untouched, undamaged, odorless, in their entirety and in their original packaging.
Article 7. Delivery
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Deliveries are made by La Poste via COLISSIMO or Mondial Relay in metropolitan France, delivery service with tracking, delivery without signature.
DELIVERY TIMES ARE FROM 15 TO 28 WORKING DAYS.
Delivery times are given as an indication only. CATALEYA may provide the purchaser with a tracking number by e-mail. The buyer is delivered to his/her home by his/her letter carrier.
The risks associated with transport are borne by the purchaser from the moment the items leave CATALEYA's premises.
The purchaser is responsible for verifying the condition of the packaging and the contents of the merchandise upon delivery, in the presence of the employee of La Poste or the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Any customs fees related to the delivery from abroad are at the buyer's expense.
In case of loss of the parcel or damage noted, Mondial Relay pays the Customer a fixed compensation of 25€ TTC per parcel (shipping costs included).
According to the value of the parcel, the Customer chooses to insure or not his parcel by adding the desired level of compensation.
Mondial Relay offers the Customer, as an option, 5 levels of insurance (N1 to N5) allowing a fixed compensation up to 500 € (option available just before purchase).
No claim concerning damage or delivery can be taken into account after a period of 3 days following the delivery notice mentioned by the centralized computer system of MONDIAL RELAY (conditions visible on the Mondial Relay site)
National or international shipments are not guaranteed in case of loss, damage or other incidents.
If you need a guaranteed shipment (according to the carrier's scale), please ask for it by mail after your order.
If a parcel is not collected from a relay point within a given period, it will be returned to the sender, who has 3 months from the date of return to store it.
After this period, the parcel will be considered as abandoned and the buyer cannot request reimbursement or return.
The company cannot be held responsible for the loss or deterioration of the parcel after a period of 3 months from the date of return of the parcel to the sender.
Article 8. Refunds
No exchanges or refunds will be made, as our items are custom-made to your specific preferences, making them unique and exclusively designed for you.
Any complaint concerning a defect of another product will have to be made by contacting only: [email protected] via the form of contact by joining a photograph of the product carrying a defect under 48h after the reception of the product. We will study the complaint and judge what action to take according to the facts reported.
We do not make any refunds or exchanges on items on sale or on promotion.
We do not exchange items after receipt in accordance with the order if the customer is mistaken on a size, model or color.
If you wish to resell a product, please do not contact CATALEYAPARIS.
The voucher are valid for one year, after which time they cannot be used or reactivated.
Article 9. Responsibility
CATALEYA, in the process of distance selling, is bound only by an obligation of means. CATALEYA shall not be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, service interruptions or other unintended problems.
Article 10. Intellectual property
All elements of the www.cataleyaparis.com website are and remain the exclusive intellectual property of CATALEYA. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photos, logos, visuals or text.
Article 11. Personal data
CATALEYA undertakes to maintain the confidentiality of the information provided by the purchaser, which he or she may be required to transmit in order to use certain services. Any information concerning the purchaser is subject to the provisions of Law No. 78-17 of 6 January 1978. As such, the Internet user has a right to access, modify and delete information concerning him. He can make the request at any time by mail at the following address: [email protected]
